ConstableA constable is an officer of the county justice courts. Constables and their deputies are the executive enforcement branch of the county justice courts. Duties include executing and returning writs of possession or restitution (evictions), serving orders of protection or orders prohibiting harassment, serving civil and criminal summons and subpoenas, and seizing property to satisfy judgments. 4-year term.Why you should care:In addition to their enforcement responsibilities, constables perform much of the community outreach required by the court, such as summoning jurors. The constable will have significant face-to-face interactions with their community. First, the main responsibility of the Constable is to properly serve court documents issued by the court.
Next there are specific ways documents are to be served in order for the service to be valid.
Last, documentation of everything served. the office of the Constable isn't simply that of a "paper messenger". The correct person needs to be served, the paperwork must be complete and in some cases the person being served must understand what they are receiving. The Constable must submit to the court a certificate of service. In that certificate everything done must be documented and it becomes a part of the court record. I also wear a body-cam so if there are any questions of what was said or done by anyone it is recorded.
The best tool you use as Constable are your words, your voice. Serving with authority yet compassion and understanding. Having the ability to de-escalate volatile situations is extremely important. I received a certificate for Advanced Police Officer Standards and Training, I am a drug recognition expert, completed training and I am an associate member of the Arizona Process Servers Association as well as the Arizona Constables Association where I attend regular training and legal updates every six months.
With 30 years experience and regular up to date training and instructions more than qualifies me for this position.
Daily challenges! Emotional people, entitled people, upset people!
People think when I arrive with a court order or a court summons "I" am the bad guy. They don't understand, someone else is asking the court to settle or enforce an issue. I am simply there to advise them so they can be prepared to defend themselves. At the same time, some people know I am coming and they don't want to see me. I often wait from 5:30 am to 8:30-9:00 am or 4:00 pm to 7:00 pm for people to come out of the house.
When serving civil papers people can get upset. Knowing how to de-escalate volatile situations is critically important. My main goal is to make certain no one gets hurt and we can all get home safely. Again, communication, compassion and understanding is vitally important.
