Thurgood Marshall said, “We must never forget that the only real source of power that we as judges can tap is the respect of the people.” Judges can earn the faith, confidence, and trust by treating everyone equally under the law; making decisions based only on the facts and the law without being influenced by personal feelings, politics or outside pressure; ensuring that the court rules, processes and procedures are transparent, consistent and responsive to the needs of all participants; and treating individuals with dignity and respect to ensure procedural fairness. Beyond the courtroom, participating in speaking events provides another avenue to improve the public’s understanding of the legal system and the administration of justice.
Indiana Code of Judicial Conduct Rule 4.1(A)(13) prohibits judges and judicial candidates from making public statements or commitments that are inconsistent with the impartial performance of the duties of judicial office. Comment 15 further clarifies that “[t]he making of a pledge, promise, or commitment is not dependent upon, or limited to, the use of any specific words or phrases; instead, the totality of the statement must be examined to determine if a reasonable person would believe that the candidate for judicial office has specifically undertaken to reach a particular result.” Given these limitations, I can state that I will strive to continue to act in an objective and unbiased manner and handle each case fairly and impartially.
While I cannot make any statement or commitment that would be inconsistent with the impartial performance of the duties of judicial office, one of my obligations as a judge is to provide open, accessible and fair courts. Monroe County has demonstrated a willingness to adopt innovative initiatives and programs that seek to address and reduce barriers faced by community members in civil, criminal and juvenile proceedings. Maintaining, strengthening and expanding the significant investments in programs such as the Alternative Dispute Resolution Program, the Pretrial Release Program, the Juvenile Detention Alternatives Initiative (JDAI) and our Problem Solving Courts are ways to create a fair, equitable and effective system.
