Somerset County Surrogate

The Somerset County Surrogate probates wills: qualifies executors, administrators, and trustees and issues necessary documents for administering estates. As custodian of the funds belonging to minors’ estates, oversees the minors' assets and expenditures until the minor reaches majority. Processes mental incompetencies and conservatorships and handles all adoptions of minors and adults.The Surrogate serves a five year term.

The county Surrogate is an elected Constitutional Officer who serves as judge of the Surrogate’s Court for uncontested probate and estate matters. A Surrogate also serves as Deputy Clerk to the Superior Court for the Probate Part, including guardianships of incapacitated adults, as well as adoptions in the Family Part. The Surrogate: Must be a resident of the county in which they serve. Must be at least 18 years old. Must adhere to ethical standards and maintain professional conduct. Must be a citizen of the United States. Must be a registered voter in the county. Must have a high school diploma or equivalent. Must not have been convicted of a disqualifying crime.
The Surrogate's office has been in the process of updating its serves for the last five years. It is now open to the public one night a week to better serve the people in Somerset County. We have an off site location once a month on a Saturday to assist the people who cannot make it to our office on weekdays. We have automated our telephone system so that our residents can speak directly to person and not an answering machine. We have implemented an on line filing system for Probate of wills and administration of estates. We have implemented a credit card system for payments. We have made the filing of the Well Being reports for parents a little less stressful.
