I am a former probate judge and I have had an active private probate practice for 14 years handling over 400 files while my opponent handled a low double digit number of cases. I have also taken a significant amount pro bono assignments from the various probate courts to represent individuals in probate matters while my opponent has taken none of those cases to my knowledge. I have taught continuing legal education courses regarding probate practice to fellow lawyers and made presentations to the public regarding the probate court and practice.
The court requires annual accountings for financial guardians and personal status reports. In addition Guardians are required to report to the court any unusual event or planned invasive medical procedures to ensure that respondents civil and human rights are protected.
The statute requires the court to assess if there are no alternatives to guardianship available and if the evidence supports the need for a guardianship. A guardianship must be limited in scope and duration to the minimum necessary to provide for the care and wellbeing of the respondent while respecting their human and civil rights. I follow the statute with particular emphasis on the empathy, courtesy and respect for the individuals rights and particular situation. There is not one size fits all guardianship. Each case must be evaluated on its individual merits.
