Ballot Language:The City Charter does not provide a provision for removal of a council member from office. Shall the City Charter be amended to provide for council member removal from office for violations of the City Charter or adopted rules after an independent magistrate hearing upon which there is a finding of intentional, willful, flagrant, or continuous violations?Synopsis:In May 2025, the City Council appointed members to the Charter Review Committee to perform a full review of the City Charter for updates and/or changes.This referendum adds an additional section to the City Charter: Section 306.1. – Removal from Office. A Council Member may be removed from office by the city council for violations of the city charter or city council adopted rules if said violation by the affected council member is found, after an independent hearing, to be intentional, willful, flagrant, or continuous.Recent issues have arisen within the City Council which highlighted the need for a removal process in cases where there was an intentional, willful, flagrant, or continuous violation of the city charter or adopted rules, but lack of meeting the requirement of being guilty of a 2nd degree misdemeanor. This referendum is directly tied to Referendums 6, 7 & 8 which specifically outline Prohibitions, Forfeiture from Office and the Handling of Vacancies.
