Gulfport Referendum #6 Prohibitions

Ballot Language:The City Charter presently provides that council members who are convicted of directing or requesting the appointment or the removal of a city employee to be guilty of a criminal 2nd degree misdemeanor. Shall the City Charter be amended to remove the language regarding the potential criminal conviction of a council member of a 2nd degree misdemeanor? Synopsis:In May 2025, the City Council appointed members to the Charter Review Committee to perform a full review of the City Charter for updates and/or changes.The current City Charter states “any council member violating the provisions of this section, shall be guilty of a 2nd degree misdemeanor and upon conviction thereof shall cease to be a council member”. This referendum would broaden the actions that may lead to removal of a council member by removing this limiting language. This referendum is directly tied to Referendums 7, 8 & 9 which specifically outline Removal/Forfeiture from Office and the Handling of Vacancies. Yes - For the MeasureBroadens the actions that may lead to removal of a council member by removing the limiting language requiring guilt of a 2nd degree misdemeanor.No - Against the MeasureLeave the current provision in place requiring guilt of a 2nd degree misdemeanor to cease holding a council seat.
