SCROLL DOWN FOR SPANISH TRANSLATIONCITY OF FORT COLLINS PROPOSED CHARTER AMENDMENT NO. 2, REPEALING AND REENACTING ARTICLE IX OF THE CITY CHARTER RELATING TO RECALLBACKGROUNDThe City Clerk’s Office has requested changes to Article IX (which addresses the RECALL PROCESS) to address ambiguities, inconsistencies, and process complexity and substitute active and direct terminology and use gender-inclusive language. The recommended changes would increase the timeframes for circulation of a recall petition, including an additional increase in the time to circulate a petition to recall the mayor. The same percentage requirements for signatures would be retained. Changing the timeframe for the Clerk to examine petitions recognizes volumes (such as numbers of petition signatures to review) have increased and the timeframe needs to be more in line with Colorado state statutes.The current process for petitions allows for “cure,” meaning the petition may be withdrawn if determined insufficient and an additional 15 days is allowed for amending the petition. The amendment removes this as these “cure” procedures are not well utilized or understood and are generally inconsistent with municipal election code.The process for protesting a Clerk determination of sufficiency of petitions is updated to be consistent for each of the three (recall, initiative, and referendum), and adjust time frames. Time frames have been tightened except a slightly longer time frame for arranging, setting, and providing notice of the protest hearing is included. This will allow more time for preparation.Current timeframes are unworkable under current election requirements and limitations. The proposed changes would allow sufficient time for the conduct of an election; consolidate the election with the regular November municipal or General election, unless the date is at least 77 days prior; terminate a recall process if the relevant office is already on the November ballot and the election was consolidated; and terminate the recall if the officer subject to recall resigns before ballots are mailed out.A section on computing time for deadlines has been added to clarify how deadlines are affected by holidays, weekends, and emergency closures, an issue that causes confusion and disagreement. The recommended changes require a substantial reorganization of Article IX so that the descriptions of the processes and requirements are easier to follow. Because of this, repeal and reenactment of Article IX is needed.MAJOR PROVISIONSClarifies the usage of the term “shall” by replacing with “will,” “must” or other appropriate language;Modernizes the language to be more inclusive by removing he/she language;Revises and reorganizes Article IX to be simpler, easier to follow and clearer;Retains the same percentage requirements for signatures (based on first-choice votes with ranked choice voting) and increases timeframes for circulation of a recall petition, with an additional increase in the time to circulate a petition to recall the mayor;Simplifies review process and removes the allowance for time for “cure” of technical errors and omissions;Tightens the timeframe for protest hearing and decision;Requires Council to set a recall measure for vote on the next Tuesday for which all election deadlines can be met and if that earliest meetable date is within 77 days of a November election, it must go on that ballot;Clarifies that if the office held by the subject of the recall is on the next November election ballot and the election on the recall would be at that election or later, the recall process terminates; andAdds rules for computation of time and consistent deadline timeframes, including use of “business days” for City actions and “calendar days” for petitioner actions, with deadlines at the end of the regular business day.====================================================================CIUDAD DE FORT COLLINS PROPUESTA DE ENMIENDA N.º 1 A LA CARTA QUE ENMIENDA EL ARTÍCULO VIII DE LOS ESTATUTOS DE LA CIUDADANTECEDENTESEl Comité del Código Electoral se reunió varias veces en el 2024 para considerar posibles cambios en los estatutos de la Ciudad relacionados con los procesos de elección y petición que se rigen por la Carta. La Oficina del Secretario Municipal ha solicitado cambios al Artículo VIII que rige la manera de llevar a cabo las Elecciones Municipales, para abordar ambigüedades, inconsistencias y complejidad del proceso y sustituir la terminología activa y directa y utilizar un lenguaje inclusivo de género. Para las elecciones administradas por la Ciudad, la Junta Electoral actualmente está compuesta por el Juez Municipal, el Secretario Municipal y el Subsecretario Municipal Principal. Con la Enmienda 1, la Junta estaría compuesta por el Juez Municipal, el Secretario Municipal y el principal experto electoral de la oficina del Secretario Municipal, según lo determine el Secretario Municipal.
