Clerk of Circuit Court

The Clerk of the Circuit Court is an elected Constitutional Officer whose authority and responsibilities are set forth in the Florida Constitution and Florida Statutes. The Clerk records and maintains the Official Records of Volusia County and serves both the County and Circuit Courts and as the custodian of the official court records.The Clerk has many duties and responsibilities, including recording property transactions, attending and supporting all court proceedings, maintaining official court records and providing access to those records as permitted by law, assisting victims of domestic abuse, processing child support payments, collecting court fees and fines, administering court-ordered sales, and processing marriage and passport applications. These responsibilities require the Clerk s Office to efficiently handle and manage not only millions of public records, but also millions of dollars of public money. Money generated by these and other activities is deposited in the Clerk s Office and distributed to the appropriate recipients pursuant to statutory law or court order.

Obtaining the resources to provide essential experienced and knowledgeable staff to serve the public is a continual pressing issue, especially in light of the highly competitive market for qualified employees and the complexity of duties to be mastered by deputy clerks. We must continually balance state court-related technology mandates with our local judicial and constituent technology needs. Also, at issue is the need to improve FL Clerk’s current authority to protect victim identifying information in court records when requested. Striving to increase public service quality while overcoming years of declining revenues and rising costs, our familiar ongoing challenge. Automation/speed v. caring service. Preventing record fraud.
I’ve treasured the experiences I’ve had in the development of technology advancements in record preservation and access, including advocating with the FL Supreme Court several times regarding balancing privacy versus access concerns in court records. I helped develop court rules regarding Clerks use of technology in records management and access while protecting privacy, including victim information. My office has over 100 million digitized land and court records mostly available for free at www.clerk.org. Our mission is “to make accurate information accessible to all” and our dedicated expert staff and unique custom technology programs make that mission possible for our partner agencies and the residents of Volusia.
As the Clerks Office first in-house legal counsel and eventual Chief Deputy Clerk, I’m experienced at allocating funds between competing priorities. Clerks have faced stagnant fees and flat or declining revenues for over 15 years, and I credit the incredible dedication of those deputy clerks who have taken on more work and complexity year after year with loyal determination. We operated 26% below our peer group (similarly situated Clerks) last fiscal year. I absolutely love and honor my Team, and have lead over 200 employees at numerous locations under two separate budgets (one for county functions and one for court functions) for over seven years. I am more proud of Team Clerk and what we’ve overcome together than ever.
I am the current Clerk of the Circuit Court for Volusia County, an attorney, and a uniquely experienced, qualified, and intensely dedicated Clerk. I’ve been recognized locally and statewide for accomplishments and service excellence, and I participate in numerous important professional organizations, boards, and industry groups both locally and statewide. My heart is with my staff and we call ourselves Team Clerk. We strive to set the standard for public service and our motto is We Love Helping People. And we mean that—the feedback we get on how well we serve is proof. I am the Clerk. I understand it, I care about it, I give my whole heart to it passionately and fiercely. And after all, you can’t spell cLERk without L.E.R. (Laura E. Roth).
