The justice of the peace presides over the justice court in cases involving misdemeanors, small civil disputes, landlord/tenant disputes and more. They also conduct inquests and may perform marriage ceremonies. County Justice of the Peace Qualifications A Justice of the Peace must meet the following qualifications at the time of appointment or election: U.S. Citizen Resident of Texas for at least 12 consecutive months Resident of the precinct for at least six consecutive months Registered to vote in the precinct At least 18 years of age Not have been finally convicted of a felony from which they have not been pardoned or otherwise released from the resulting disabilities Not have been determined by a court with probate jurisdiction to be totally mentally incapacitated or partially mentally incapacitated without the right to vote Candidates for this office generally must meet the above qualifications at the time of filing. My qualifications are based on academic or intellectual, ethical or moral, and philosophical or principle-oriented characteristics. Academically, I have had the education and training in law to be an attorney, in addition to being a veteran and having a degree and certifications in other fields. With regard to personal qualities, I embrace the Christian virtues of faith, hope, and charity. Although I have had conflicts and humbling experiences, I have had instilled in me, and I try to embody, the leadership traits taught in the tenets of Taekwondo; of the Boy Scout Oath and Law; of the Air Force, Army, and Navy Values; of Freemasonry; and of the other institutions which I have been a part. My given name, Daniel, means "Judged by God." While taking into consideration the paradigms and perspectives I acquired from international study and from living in the north, east, south, and west of the USA, I think everyone would want to receive the compassion and grace in judgment that I learned.
Meeting and exceeding expectations starts by planning, intending, and being willing to serve beyond minimum obligations. As a teacher, when my caseload increased with added students, I stayed later to make more evening phone calls, emails, and text messages, adapting rather than lowering standards. Diligence beyond the traditional 8 a.m.–5 p.m. schedule will help to address needs of petitioners. As Justice of the Peace, other lawful procedural tools such as Rule Nisi judgments can be used for timely docket management to resolve uncontested or routine matters promptly, while preserving full due process for contested cases. Such provisional orders can set clear expectations, encourage early compliance, and reduce unnecessary continuances that delay justice for everyone. By combining efficient procedures, communication, scheduling, technology tools, and a servant-leader’s willingness to do extra work, cases can be resolved without unnecessary delays as Denton County continues to grow.
Executing the functions of “the people’s court” relies on collaboration with the county commissioner's court, clerk, constables, other justice of the peace offices, and local municipal judges and law enforcement for cooperation and human resources. We need to build relationships with members of the Denton County Bar Association and the Texas Access to Justice Commission to increase pro bono services and raise awareness about available legal aid just as much as to fund the help to access to relief for all residents, including those who are low-income, non-English speakers, individuals with disabilities, juveniles, and the elderly. Similarly, we can expand use and take further advantage of the Denton County and the State of Texas having contracted with Tyler Technologies and other service providers that manage the Odyssey filing system as well as Modria (Modular Online Dispute Resolution Implementation Assistant) mediation, to allow more virtual and hybrid hearings and public observers.
I practice impartiality by first humbly acknowledging that, like everyone, I hold personal interests and preferences that affect my decisions. I then deliberately mitigate any conflicts by disclosing and subordinating emotions and views which would interfere with properly applying the law. Absolute neutrality may be an ideal, but honest truth and cold, hard reality teach that we all have biases. I do not arrogantly pretend to have complete impartiality. I intentionally ground my analysis in the Constitution, codified rules with the force of statute, applicable precedents, black-letter doctrines, logic, reason, and rational sense. Systemically, I advocate for insulating judicial campaigns from partisan elections entirely. Judges are not supposed to be legislators and policy-makers, so the legislature should make all judicial races nonpartisan. I publicly suggest, support, and propose term limits and mentoring successors to restore trust and reduce stagnation as career politicians.
