CO Amendment C - Conduct of Charitable Gaming Activities

Shall there be an amendment to the Colorado constitution concerning the conduct of charitable gaming activities, and, in connection therewith, allowing bingo-raffle licensees to hire managers and operators of games and reducing the required period of a charitable organization's continuous existence before obtaining a charitable gaming license?Conduct of Charitable Gaming ActivitiesThis is a referred proposal from the legislature to amend the Colorado Constitution to allow revisions to charitable gaming activities.Major Provisions:Allows bingo-raffle licensees to hire managers and operators of games of chance; andReduces the required period of existence for a charitable organization to obtain a bingo-raffle license from five years to three years.Background:Currently nonprofit organizations with bingo and raffle licenses are required to conduct those games with only volunteer members from the organization. Before the nonprofit organization can apply for a raffle or bingo license, it must have been in continuous existence for five years and submit other pertinent information. This proposal limits payment to a hired manager or operator to no more than the minimum wage. The proceeds of the game must be directed to the specific purposes of the nonprofit organization conducting the game._______________________________________________Enmienda CActividades Caritativas en Relación con Juegos de LoteríaEsta propuesta es presentada por la legislatura para enmendar la Constitución de Colorado para permitir revisiones a las actividades de los juegos caritativos.Las Provisiones Principales:Permite que organizaciones que posean licencias de juegos de bingo contraten administradores y operadores de juegos de lotería; yReduce el periodo requerido de existencia de organizaciones caritativas para que puedan obtener una licencia de juegos de bingo, de cinco a tres años.Trasfondo:Actualmente se requiere que las organizaciones sin fines de lucro con licencias de lotería realicen dichos juegos solamente con miembros voluntarios de la organización. Antes de poder solicitar una licencia de lotería, la organización debe haber estado en existencia, continuamente, durante cinco años, y deberá entregar información adicional pertinente. Esta propuesta limita pagos a administradores u operadores contratados, a no más del salario mínimo. Las ganancias del juego deben ser destinadas al propósito específico de la organización sin fines de lucro que ejecutó el juego.

The proposal would allow more opportunities for non-profits to consider running bingo raffles as a revenue stream for the benefit of their association's programs. Associations would have the choice to compensate their volunteers which in turn, would help with the recruitment and retention of the people that work the game to support the non-profit.

Paid workers will take funds away from the charitable organization conducting the game of chance thereby increasing the overhead costs to the organization. This reduces the amount of money a charitable organization can spend for its primary purpose. By removing the requirement that volunteers conduct the games, it more closely resembles for-profit gambling than charitable fundraising.
