The District Attorney is responsible for prosecuting all state criminal offenses occurring in their district. These include cases brought by the municipal police departments, sheriffs’ departments and any college police departments, and state and federal law enforcement agencies.ELECTION INFO: General Election ballots will start to be mailed on October 9th, 2020. Biographical Information

How would you address racial injustice within your district?

Are you in favor of bail reforms that have been practiced recently that allow the release of prisoners prior to their trial date versus many detainees being held awaiting the outcome of their case? Please explain.

Are you in favor of reforming sex offender felony sentencing from the current indeterminate sentencing to determinate sentencing? Please explain. (Current law allows for indeterminate sentencing which conceivably imposes being held for the remainder of their life depending on a number of factors. The change to determinate sentencing would impose a definite end date.)

How should the District Attorney’s office handle the current backlog of cases going forward? What concerns do you have about handling the backlog and its effect on outcomes?

Background I grew up in Aurora and graduated from Heritage High School. I joined the District Attorney's Office in 2006 and I currently supervise our felony unit and 30 attorneys. Prior to joining the DA's Office, I worked in the Clinton White House and attended the University of Colorado Law School.

Racism, discrimination and social injustice have plagued our country since its founding. As our country faces a racial reckoning, we must root out racism and address the inequities in our criminal justice system. This will be one of my top priorities.

As the next District Attorney, I will:

1) Work towards ending the school to prison pipeline 2) Invest in diversion programs and specialty courts as alternatives to incarceration 3) Mandate annual implicit and explicit bias training 4) Evaluate our charging decisions to eliminate any racial discrimination 5) Hire a diverse workforce that reflects the community we serve 6) Create a civilian review board to increase transparency 7) Vigorously investigate and prosecute incidents of police brutality 8) Invest in schools, senior centers and other community organizations to prevent crime and reduce recidivism

Addressing racial injustice needs commitment and determination. I will be a leader on this issue from day one.
The purpose of bail is to ensure that a defendant will appear for trial and all pre-trial hearings. It is also meant to protect the community from people who are dangerous or who pose a flight risk. Bail should not be used as a punishment and should absolutely not be used to keep poor people in jail. I will work with authorities and stakeholders to improve our risk assessment tools to ensure that bail is being used properly in my jurisdiction. And I support responsible bail reform measures that seek to prohibit poor people from remaining in jail simply because of their economic status, while still ensuring that high risk offenders cannot harm our community and that they appear for their court dates.
I do not support a change in the sentencing statute for sex offender felony offenders. The current statute appropriately allows a court and proper authorities to assess and then keep dangerous, convicted sex offenders from harming the community. I do not support efforts to change this.
In the 17th Judicial District (Adams and Broomfield counties) we have somewhere between 50,000 and 60,000 cases in our jurisdiction every year, from traffic cases to DUIs to sex assaults and murders. This is an enormous caseload in normal times, but is especially challenging during the COVID-19 pandemic. Handling these cases requires competent and ethical attorneys, staff, paralegals, victim advocates, and investigators. I will retain, hire and build a staff of the finest professionals and will hold them to the highest standards of ethics. And with that, we will seek justice in each of our cases and will do so with professionalism and integrity.

Systematic discrimination is among the most despicable injustices imaginable and has no place in the criminal justice system. Possible causes include over-policing of communities of color, and overt and implicit bias. These issues should be addressed by reviewing relevant data and working to promote equity so that a better relationship can be pursued between the District Attorney and the communities they serve.

Education would be vitally important in my administration. Focus would be on training attorneys, staff and law enforcement to identify implicit bias or racial disparity. Once identified, exclude it from consideration in filing decisions, charges, plea dispositions and sentencing recommendations to the courts.

As District Attorney, I would mandate that any decisions made be based on the seriousness of the crime, the facts of the case, the amount of evidence available to prove guilt and the prior criminal record of the offender regardless of race or gender.
A District Attorney has the ability to implement and encourage significant changes in the use of bail in their district. I support informed discussions regarding the current system related to bail but not eliminating cash bail in certain circumstances. A fundamental aspect of bail should be community safety while also serving the purpose of ensuring that an offender will appear for all future court hearings. Bail shouldn't be used as punishment. Appropriate factors for bail consideration should include the seriousness of the case, an offender’s criminal history and the presence of past failures to appear for court proceedings.

Providing more discretion and common sense in applying bail is needed. I would advocate for a balanced approach that provides more discretion to the courts with informed arguments from all parties that maintain and prioritize public safety and lessen community safety risks.
Sexual violence is complex and difficult to discuss but the fact is that sexual violence is an issue of epidemic proportions that impacts all of society including here in Colorado.

The goal behind indeterminate sentences is that the offender will avail themselves of appropriate treatment while incarcerated and be rehabilitated in order to seek and obtain parole. Since individuals respond differently to punishment, prison officials generally support indeterminate sentencing because the prospect of earlier release is an incentive to behave. On the other hand, determinate sentencing can lead to greater fairness as judges have little discretion in imposing them therefore individuals who commit similar crimes receive similar sentences.

This question requires more information such as what the underlying legislative content would or may include or how it is being proposed and why before I could adequately and in good faith make a decision to support or oppose reform.
Public safety is my top priority for the Office of the 17th Judicial District Attorney. One of the first steps is assessing the extent of the current backlog of pending and current cases. Case reviews may include case status, case evaluation, the severity and appropriateness of charges and the amount of evidence available. Case evaluation would also take into consideration the potential for revision of plea bargains, potential reduction of charges and possible referrals to problem solving courts or diversion programs. Additionally, examinations of cases where the better use of resources could be utilized in appropriately resolving cases in a manner that limits exposure to the criminal justice system and reduces recidivism.

Concerns include, but aren't limited to, available resources, staffing concerns, potential lack of knowledge or lack of training on the part of the assigned prosecutor and availability of courtrooms to hear cases. The outcome should not compromise public safety.
